The Oireachtas sub-committee on 'European Scrutiny' lists 276/2005
(aka IPRED2) as one of the items on its agenda for tomorrow (Thursday
6th) - it's along with a truly weird list of other proposals
including "placing on the market of rye bread with added phytosterols/
phytostanols as novel foods or novel food ingredients" (!), so I'm
not sure how much detailed attention it will get.
This may have been mentioned on the list before, but I'm not entirely
sure. Apologies if so.

sorry, I didn't get to draft a new letter, will try again tomorrow
* think about how we describe SCOs cash-needy state pre-litigation (without slander etc.)
=== The text of what'll be our first letter ===
+
+ A letter should be sent to Anne Coleman-Dunne and copied to Michael English - both in Entemp.
+
+ They will have input into both the Directive and the Council Framework Decision.
+
+ If we mention:
+ * the problems from the FSFE page
+ * one or two more if we can think of some
+ * an explanation of why "intentional" and "commercial scale" are not
+ significant limits
+ * comment on the difference between current Irish law and this proposal.
+
+ then we'd have a great letter. But none of these are show stoppers, so
+ sending something should be the priority.

+ === Text of a previous letter, for cannabalising ===

At least you'll get one smile from their website, the page titled "Case for
IP Protection" is blank :)

"BASCAP", of course, is just yet another name for the usual suspects - it's
supporters are Vivendi Universal, EMI, Microsoft, CropLife (Monsanto), BSA,
etc. (full, long, list: http://www.iccwbo.org/bascap/id884/index.html )
Here's their recent press release:
> GLOBAL CEOS FORM COALITION TO FIGHT COUNTERFEITING AND PIRACY
> London, October 4, 2005 -- Business leaders from some of the world's top
> companies today formed a unique coalition to take the fight against the
> theft of intellectual property to the highest international level.
> Meeting under the banner "Business Action to Stop Counterfeiting and
> Piracy" (BASCAP), the corporate leaders warned that this illegal
> activity - estimated at $600 billion - is threatening the
> knowledge-based economy of the 21st century.
> Business leaders today agreed an initial 4-point plan of action and
> launched a recruitment drive to mobilize other CEOs from different
> countries and the spectrum of affected industries.

___________________________________/ patents and IPRED2 http://fsfe.org
Hi there.
This is a post to try to get the ball rolling again on our IPRED2
work. We need to write either a letter or a position document on
this issue. We had one mostly written:
http://www.ifso.ie/cgi-bin/wiki.cgi/IPRED2
but, in a committee post, Ciaran observed that it had problems:
"One problem with the letter we were working on is that many EU member
states already have criminal sanctions for intentional,
commercial-scale copyright infringement. This means our SCO example
will be met with: 'Yeh, but that's the USA. EU member states already
have these provisions and I see no harm done'."
We have two good sources to work from:
FIPR: http://www.fipr.org/copyright/ipred2.html
FSFE: http://www.fsfeurope.org/projects/ipred2/ipred2.en.html
and Teresa has given us a useful overview of the Irish angle:
"There are no plans for a consultation on the implementation of
IPRED1. The responsible for IPRED2 is Anne Coleman-Dunne. [...]
she's the person to whom any letters or statements should be
addressed (maybe copied to Michael English)."
Note that we may need to work at both the Irish and European level.
The "What we can do" section of our wiki page lists:
* Ammend the directive to not be so broad
* Get the Council to throw out the Framework Decision
(which requires unanimitiy)
* Get the Framework Decision amended
* Get some nice enforcement exceptions into the directive
(writing/using/distributing software cannot constitute a patent
infringement, or whatever)
Ciaran, can you offer an opinion on whether the letter on our wiki
page is a suitable starting point, or whether we should start from
scratch.
Good luck,
Malcolm.
