Dies war ein wichtiger Monat für Freie Software. Es wurde nicht nur (wie
immer) am 20. der Software Freedom Day gefeiert; dieses Jahr jährt sich
auch die Entstehung GNU-Projekts zum 25. Mal. Feiern fanden in ganz
Europa statt und unsere Fellows fördern weiterhin Freie Software
auf lokaler Ebene mit Begeisterung und Leidenschaft.
Andere wichtige Dinge ereigneten sich: Auf der strategischen Ebene hat
die FSFE sich mit Vertretern der Weltbank beschäftigt, um zu erklären,
warum Freie Software sowohl für Politik als auch Wirtschaft wichtig
bleibt. Auf rechtlicher Ebene fanden weiterhin Treffen, Vorträge,
Podiumsveranstaltungen und Kurse statt und bauten so weiter an der
Infrastruktur der Zukunft.

1. GNUs 25. Geburtstag in Berlin, Deutschland
Das GNU-Projekt wurde am 27. September 25 Jahre alt. Die FSFE und die
Berliner Fellows waren am Brandenburger Tor um die Korken knallen zu
lassen. Die Feier startete um 15 Uhr mit Sekt und Musik. Alle hatten
Spaß!
2. Die kleinste Einheit der Freiheit: Ein Fellow - Sean Daly
"In Europa bekümmerte mich die schleppende Umsetzung des Monti-Urteils
von 2004 durch Microsoft und ich sah, dass bis auf ganz wenige Ausnahmen
die Mainstream- und Technikmedien nicht die ganzen Geschehnisse abdeckten,
insbesondere die wichtige Rolle der Parteien, die das Verfahren unterstützt
haben, wie Samba und der FSFE. Da traditionelle Journalisten einen
entscheidenden Teil der Geschichte übersahen, fühlte ich, dass es
vielleicht an der Zeit wäre, dass ein nicht so traditioneller Journalist
aufsteht und über diesen Teil berichtete."

3. Erreiche die Leute - Software Freedom Day in Berlin, Wien und
Utrecht
Am Samstag dem 20. September veranstalteten der FFII und die Berliner
Fellowshipgruppe zusammen ein Grillfest und einen Infostand. Am Infostand
erklärten die Fellows, was Freie Software ist und warum sie für die
Gesellschaft wichtig ist. Währenddessen feierten die Wiener Fellows den
Software Freedom Day im "Pint Pub" in Wien. Der Höhepunkt der
Veranstaltung waren die Auftritte der Bands "Club Valat" und "Klaus
(from Fadin' to Whiteout)". Schlussendlich hielt Shane Coughlan,
Koordinator der Freedom Task Force der FSFE, einen Hauptvortrag bei der
niederländischen Veranstaltung zum Software Freedom Day am Liefland
College, Utrecht.
4. Fellowship-Veranstaltungen in Europa
Die Fellowshipgruppe in Berlin traf sich am 11. September an ihrem
üblichen Ort, dem New Thinking Store in der Tucholskystraße. In Wien
lud die örtliche Gruppe von Fellows Shane Coughlan, Koordinator der FTF,
ein, einen Vortrag zum Thema "Die Professionalisierung Freier Software.
Wohin wir als Nächstes gehen." zu halten. Die neue Züricher Gruppe hatte
ebenfalls ein Treffen und kam wiederum im Züricher FSFE-Büro zusammen, um
Wege zur Verbreitung des Wissens über Freie Software zu diskutieren und
um einen netten Abend zu verbringen. In Lille wurde von unserem neuen
französischen Praktikanten, Benjamin Morant und Rainer Kersten vom
Düsseldorfer Büro, ein Stand auf der "Braderie de Lille" (Liller Floh-
markt) veranstaltet.
5. Freie Software für von der Weltbank finanzierte Projekte
FSFE-Präsident Georg Greve hielt einen Vortrag als Teil des jährlichen
Kurses "Beschaffung von Informationssystemen in von der Weltbank
finanzierten Projekten" im Internationalen Trainingszentrum (ITC) der
Internationalen Arbeiterorganisation (ILO) in Turin, Italien. Wie in den
letzten Jahren, gewährte der Kurs den Managern der Weltbank Einblicke in
ökonomische und politische Hintergründe Freier Software und in
praktische Problemstellungen wie Lizenzen, Geschäftsmodelle und gelungene
Umsetzungsbeispiele.
6. Aktivitäten der Freedom Task Force - GPLv3 in den Niederlanden,
Podiumsdiskussionen in Italien und Vorträge in Winterthur
Shane Coughlan, Koordinator der Freedom Task Force der FSFE, hielt am 19.
September einen dreistündigen Workshop zum Thema "Lizenzfragen und
rechtliche Probleme im Licht der GPLv3" zum Start der GPLv3 an der
Universität von Tilburg in den Niederlanden. Diese Veranstaltung wurde
durch NLnet gesponsert. Er vertrat ebenfalls die FSFE im Forum "NESSI
Open Source Working Group" auf der OSS-2008-Konferenz in Mailand um Freie
Software und die Gründe für Freie-Software-Lizenzen zu erklären. Darauf
folgte noch ein Vortrag "Lizenzen Freier Software und andere Fragen" am
17. September auf der OSiM World in Berlin und ein weiterer zum Thema
"Die strategische Umsetzung Freier Software in der Wirtschaft" am 25.
September auf der OpenExpo Konferenz in Winterthur, Schweiz.
7. Interessenvertretungsgruppen des europäischen rechtlichen Netzwerks
in London und Brüssel
Das rechtliche Projekt der FSFE - die FTF - koordinierte ein Treffen von
Interessenvertretungsgruppen in London, bei dem Geschäftsprozesse und
Lieferkettenmanagement diskutiert wurden. Ein weiteres Treffen wurde am
29. September in Brüssel veranstaltet, um Softwarepatente und andere
rechtliche Probleme zu diskutieren. Diese Treffen wurden für die Mitglieder
des europäischen rechtlichen Netzwerks der FSFE veranstaltet und es wird
erhofft, dass die dadurch ausgelösten Diskussionen zu größerem Verständnis
und größerer Unterstützung für Freie Software durch europäische rechtliche
Entscheidungsträger führt.

8. FSCONS 2008, Göteborg, Schweden (2008-10-24 bis 2008-10-26)
2008 wird die FSCONS zusammen von der FSFE, Creative Commons und
Wikimedia Schweden veranstaltet. Es wird drei Tracks (Freie Kultur,
Freie Software, Freie Inhalte) geben, die jeweils von einem der Haupt-
organisatoren angeführt werden. Die Themen reichen von modernem Kernel-
design über Bürgerjournalismus bis zu Lizenzierung im 21. Jahrhundert.

Die FSFE nimmt teil an der NLUUG Herbstkonferenz am Donnerstag, dem 6.
November. Dieses Jahr ist "Mobilität" das Thema. Kommen Sie an unseren
Stand und fragen Sie uns nach Freier Software! Shane Coughlan,
Koordinator der Freedom Task Force der FSFE, wird einen Tag später, am
7. November am selben Ort eine Rede über "Die strategische Umsetzung
Freier Software in der Wirtschaft" halten. Die erfolgreiche Umsetzung
Freier Software erfordert ein Verständnis der besten Richtlinien und
Prozesse, die auf den Kontext anwendbar sind. Shane wird diskutieren, wie
das rechtliche Projekt der FSFE und ihr europäisches Netzwerk von
Rechtsexperten sich in dieser Sache engagiert haben, dadurch dass sie
am Markt verfügbares Wissen für Liefer- und Einkaufsverträge, Dokumente
für Arbeitsabläufe und Entwicklungsmethoden erstellt haben. Der
Veranstaltungsort für beide Konferenzen ist Hotel und Kongresszentrum
"De Reehorst" in Ede in den Niederlanden.

Inside FSFE, we talk a lot about our legal department, the FTF. I was in
the Zurich office a while ago with the FTF's coordinator, Shane Coughlan,
and took the opportunity to gather some info for anyone interested.
The FTF works in five main areas:
1. Building a European legal network
2. Producing documentation
3. GPL enforcement
4. FLA agreement for copyright management
5. Training and consultation
1. Legal network
For two years now, Shane's been building this network of lawyers and licence
experts which now includes 145 members. Three quarters of the members are
lawyers. The others are experts in company policy, licences, or technical
aspects of licence enforcement. About 120 come from Europe, and the others
are spread across The Philippines, Japan, Singapore, China, Taiwan, South
Korea, Australia, Canada, and the USA.
I think most network members support FSFE's work. I know others don't, and
that's ok. Whether we share a vision for the future or not, everyone has to
obey the GPL, so it's useful for free software licence compliance
specialists to talk with each other and share best practices. Most
discussion is about the GPL, but we talk about all free software licences.
Other topics such as software patents and antitrust are also discussed.
FTF organised Europe's first free software legal conference in Amsterdam in
April with 53 members of the legal network attending - 5 coming from outside
of Europe. Feedback from the attendees was very positive, so there'll
certainly be more such conferences in the mid-term future.
2. Producing documentation
Some of the documentation produced by FTF is already online - there's a
documentation section on the website. One type is the documents Shane
produces, such as the useful tips for users of GPL, and same for vendors of
GPL'd software.
Another type is the documents that the network members pass around among
themselves. These are usually procedures, guidelines and other documents
that have existed for a long time internally in their various companies. If
these documents cannot be published, then at least by circulating them
privately in the network, they can expand the knowledge of many free
software lawyers. In the long term, some of these documents might become
publishable or, if allowed by the author(s), will be used for the basis of
our own documents.
3. GPL enforcement
This is the quietest part of FTF's work. We don't go to court, and we don't
go to Slashdot. Compliance is gotten while maintaining relations with the
distributor. Of course, we also work with gpl-violations.org, which does
take people to court. We've been working with them since FTF started in
2006, and earlier this year we agreed to deepen that relationship. And to
reduce problems originating from the manufacturers, the "for users" and "for
vendors" useful tips have been translated and distributed in Chinese and
Korean (they're temporarily offline during a webpage reorganisation).
4. FLA: Fiduciary Licence Agreement
The Fiduciary Licence Agreement is used when a developer wants to grant an
organisation the ability to enforce the licence of the code, and give them
the ability to update the licence of the code - with the limit that the new
licence must also be a free software licence. The developer doesn't lose
their copyright, so they can also enforce and change their licence of their
code, without limits.
This is important for legal maintainability of a project. If a problem is
discovered with the licence, having a central body maintaining the copyright
would allow the project to avoid the difficulty of find all past authors and
getting unanimous agreement on what changes to make to the licence. A big
recent success is that KDE announced that they're going to use it. More good
news is that it should soon be in 10 languages. FSFE has become the legal
guardian for a small number of project, such as OpenSwarm and Bacula, but
that's not our focus for the FLA.
5. Training and consulation
Lastly, Shane visits companies or regions to deliver training courses on
free software licences and legal issues. A skeleton course is online on the
SELF platform: The strategic implementation of Free Software in business.
These courses are educational for legal experts dealing with free software,
and they're also a way for the FTF to be financially sustainable. If you
work for a company that has a legal department and that deal with free
software, you can help the FTF by suggesting to your boss that they get
Shane to deliver a course. With so many big companies profiting from free
software, and with the FTF providing value to so many lawyers for free, it's
only right that the costs of the FTF be covered by these companies rather
than the income we get from the community (through the Fellowship). Another
significant source of funding for which we're grateful is NLnet.

Diesen Monat führte Ciarán O'Riordan ein Interview mit Rolf Camps über
Übersetzungen, Freiwillige Arbeit und Bewußtsein über Freie Software [1]
in Belgien. Übersetzungen sind absolut entscheidend für eine
europäische Organisation wie die FSFE [2]. Und es ist eine Menge Arbeit
welche meist nicht mit viel öffentlichem Ansehen verbunden ist. Deshalb
wollte Ciarán in dem Interview mehr über die Motivation von Rolf für
diese Arbeit erfahren.

nach jahrelangem Ringen , haben wir uns nun entschlossen ein
Softwareprojekt
als " Opensourceprojekt "zu realisieren. <http://dev.let.de/>
Wir würden gerne eine Lizenz nutzen, welche es uns erlaubt " non
commercial" Nutzung
als "free" software anzubieten und bei "commercial use" Geld zu
verlangen.
Gibt es da irgenwelche Dokumente die ein ähnliches Szenario
beschreiben ?

Nächste Woche findet in München die SYSTEMS statt. Die FSFE wird dieses
Jahr zum ersten mal mit einem Stand vertreten sein.
Wir wollen diese Gelegenheit nutzen, um die Fellows aus München und
Umgebung kennen zu lernen und euch gleichzeitig die Möglichkeit geben,
euch mit uns über die aktuellen Themen der FSFE und der Freien Software
Welt auszutauschen.
Dafür werden wir zusammen mit dem OpenOffice.org-Stammtisch ein
Fellowship-Treffen am Mittwoch, den 22. Oktober um 19Uhr im
Augustinerkeller in der Arnulfstraße (www.augustinerkeller.de)
veranstalten.
Eingeladen sind neben unseren Fellows alle, die sich für Freie
Software und für die Arbeit der FSFE interessieren.

Mein Projekt OpenXPhone ist das Projekt, ein Gerät zu bauen, welches
Handy und *Mobiles X Terminal* in einem ist, und es Menschen, die sich
einen Computer nicht leisten können, z.B in der Dritten Welt,
ermöglichen wird, sich an einem Computer einzuloggen und zu lernen, ihn
zu bedienen. Es wird komplett auf Freier Software beruhen, wie z.B. auf
Minix3.
Das Projekt OpenXPhone zu verwirklichen, erscheint jetzt als dringender
als je zuvor: Google's G1 - siehe angegebenen Link - ist von der
Hardware her beinahe identisch mit dem, was ich machen will. Von der
Software und Funktionalität her ist das G1 jedoch diametral
entgegengesetzt zu dem, was ich erreichen möchte. Es beruht
selbstverständlich auf Closed Source Software, und es praktiziert das so
genannte "Cloud Computing", bei welchem der Benutzer die Kontrolle über
seine Daten verliert.

cellphone and *mobile X Terminal* in one, thus enabling people who
cannot afford a computer, for example in the 3rd world, to learn to log
in to and operate a computer. It will completely based on Free Software
such as Minix3.
To realize the OpenXPhone Project seems now more urgent than ever
before. Google's G1 - see the link - is with respect to the hardware
almost identical to that what I want to do. With respect to the
functionality and the software, it is however diametrically opposed to
that what I want to achieve. Of course it is based on Closed Source
software, and it does the so called "Cloud Computing", where everthing
is in the web, for example at Google, and the user is loosing control
over his own data.

Lenovo - schizophrenic Microsoft Windows Vista refund in Germany
Today I read Hanno's blog entry [2] about his failed Microsoft
Windows Vista refund. He used the same formula as I did. He got the
answer (rough translation):
We won't refund your windows-license, because we think it's an
integral part of the product.
Side note: I got 30 EUR without any answer on my bank account.
As you might know we have a Windows tax refund [3] where we want to
summaries all essential information about this topic. (Yes the page
is in the first beta ;)).

with in Germany at the moment, please report your experience to
