Hallo Leute,
ich war mal neugierig und habe mir deswegen gerade die sehr ausführlichen Nutzungsbedingungen auf Kickstarter.com durchgelesen. Die sind bislang das Heftigste, was ich diesbezüglich gesehen habe.
Die Geldgeschäfte laufen offenbar über Amazon und daher übernimmt Kickstarter dafür schon mal keinerlei Haftung.
Unterm Strich steht da noch deutlicher als sonst: Kickstarter verspricht absolut nichts, aber überträgt alle Rechtsverbindlichkeiten und möglichen Propleme den Nutzis. Darüber hinaus beharren sie auch noch darauf, dass sie völlig willkürlich und ohne jede Kommunikation Profile und Inhalte löschen wollen.
Wer den Dienst nutzen möchte kann nur blind daruf bauen, dass kickstarter niemals ein Interesse daran haben wird die eigenen Inhalte oder Abwicklungen zu behindern bzw. motiviert genug ist immer alles funktionstüchtig zu halten und dass nie eine Situation auftreten wird, bei der ein Rechtsstreit wegen Veröffentlichungen in diesem Portal entsteht. Andernfalls ist es aus meiner Sicht unmöglich solch einen Vertrag annehmen zu wollen, denn er drückt unterm Strich nur aus, dass Leute, die den Dienst benutzten, zwar keinerlei Rechte haben, aber dafür alle möglichen Verbindlichkeiten und Risiken auf sich nehmen.
Faszinierend, dass sich solche Nutzungsbedingungen etablieren konnten. Vermutlich machen sich viel zu wenige Leute die Mühe diese Bedingungen auch zu lesen, bevor sie sie akzeptieren.
Einige Zitate:
"The Company may terminate your access to the Service, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. ... Any fees paid to the Company are non-refundable."
"The Company reserves the right to, at any time, for any reason, and without notice: (i) cancel, reject, interrupt, remove, or suspend a campaign or project; (ii) remove, edit, or modify any Content, including, but not limited to, any User Submission; and (iii) remove or block any User or User Submission. Kickstarter reserves the right not to comment on the reasons for any of these actions."

Der letzte zitierte Satz ist besonders faszinierend.
Vielleicht bin ich naiv andere Bedingungen zu erwarten und Ihr findet das ganz normal, aber wenn ich so etwas lese, vergeht mir irgendwie schon die Lust mich zu registrieren...

Verstehe ich und mor geht es genauso. Allerdings hätte ich die Bedingungen im Falle einer Registrierung vielleicht gar nicht so genau gelesen. Willst Du mal Hugo Roy hugo@fsfe.org kontaktieren? Er steht hinter http://tosdr.org/ und die beschäftigen sich genau mit sowas. Kickstarter ist dort noch nicht aufgeführt, daher würde ihnen diese Information sicher helfen…
