ich weisz es ist verdammt kurzfristig, aber wollen/koennen wir hier auch etwas beitragen mit einer eigenen stellungnahme?

aktuell ist gerade ein Gesetzesentwurf[1] in Begutachtung, durch den die Richtlinie 2014/53/EU umsetzen soll. Die Begutachtungsfrist endet am kommenden Dienstag (16.8.2016), also in 4 Tagen.

Ich bin dafür, dass wir uns an dieser Stellungnahme beteiligen. Bisher sind Funkfeuer und Netzfreiheit* an Board.

Ich habe die Stellungnahme, welche nicht schlecht ist, einmal grob überflogen. Das Problem das ich sehe ist, dass die technischen Vorteile einer freien Lösung zu erläutern etwas spät ist bzw. meiner Einschätzung nach *keinen* Hinderungsgrund darstellt das Gesetz so umzusetzen.
Hat denn niemand von uns diese Richtlinie mitbekommen in Brüssel? Aber egal, jetzt ist es relativ spät und alsbald kommt die nationale Umsetzung bzw. geht das ganze als schätze ich einmal Regierungsvorlage ins Parlament.
Könnte man nicht argumentieren, dass ein Verbot von Router Updates bzw. auf alternative Firmware (Lockdown) mit Routern auf einem Linux Kernel (GPLv2) basierend eine Urheberrechtsverletzung darstellt?
Vielleicht ist mein Ansatz zu trivial, aber wir haben doch die AVM Geschichte in Deutschland, welche ja meines Wissens nach durch-judiziert wurde!
Feedback wäre von Vorteil für mich, denn ich würde diesen Sachverhalt gerne an meinen EU Abgeordneten schreiben.

wir haben eine kampangne dazu [0], die ist aber leider auch erst letztes jahr angelaufen glaube ich

schwierig, stichwort TIVOizaton: sie muessen dir compelierbaren code geben, duerfen dich aber daran hindern die software nachher auf der hardware einzuseten :( (ist ja auch der grund fuer die aenderungen in der GPLv3 in dem bereicht...so gesehen hast da mit GNU userlang vielleicht eine chance)

ein ansatz den ich schon gehoert hab gegen oswas ist unter anderem der, das hier auch der not/katastrophen betrieb eingeschraenkt wird in dem es ja unter bestimmten bedingung erlaubt ist auch modifizierte geraete einzusetzen (und besonders erbost sind die funkamateure...die duerfen ja gesetzlich modifizierte und selbst gebaute funkanlagen betreiben...)
hier leisen sicht evtl die 4 freiheiten agrumentieren...
interesanterweise rudert die FCC bei einer vergleichbaren geschichte grad ein bisserl zurueck[1],[2]

OK, jedenfalls müsste man in der Firmwire Hardware eines Routers irgend eine GPLv3 Software finden um mit GPL violations zu argumentieren.
