I read the events as Neelie Kroes having sold herself out.

Microsoft Tax on information access: 10000 EUR
Microsoft Tax on commercial distribution: 0.48% (hello Red Hat)
No Microsoft Tax only for non-commercial (bye bye Free Software business)
For added points: Comission still pretends Software Patents are valid
