Nästan en månad gamla nyheter men jag snubblade över det först nu.
Återigen får Jan Rosén jobbet som enmansutredare, vilket troligen
innebär att vi inte kommer att gilla resultatet av utredningen. Jag har
inte läst mer än det som klistras nedan men en del saker låter ju rätt
allvarliga för oss, tex "om författare med flera bör få en rätt till
ersättning som inte kan avtalas bort".

Jan Rosén utreder upphovsrättens övergång
Justitiedepartementet: Regeringen anser att upphovsrättslagen har blivit
svåröverskådlig efter alla ändringar som införts och har därför beslutat
att tillsätta utredningen Översyn av vissa frågor om upphovsrätt.
Professor Jan Rosén har utsetts till särskild utredare.
Utredningen består av tre delar:
* En översyn av bestämmelserna om upphovsrättens övergång i bland
annat anställnings- och uppdragsförhållanden. Där ingår bland annat
frågan om en så kallad arbetsgivarregel bör införas, det vill säga en
bestämmelse om att upphovsrätten till exempelvis en tidningsartikel som
framställs inom ett anställningsförhållande ska övergå till
arbetsgivaren om inget annat har avtalats. Utredaren ska inom ramen för
denna del av uppdraget även titta på om upphovsmännens ställning som
avtalspart bör stärkas. Det handlar bland annat om författare med flera
bör få en rätt till ersättning som inte kan avtalas bort och om en
organisation som företräder upphovsmän bör få en självständig rätt att
förhandla med en arbetsgivarorganisation om till exempel ett ramavtal.
* Utredaren ska vidare se över vissa frågor om så kallade
avtalslicenser. Avtalslicensordningen är ett förenklat sätt inom
upphovsrätten att träffa avtal i situationer där det exempelvis är
omöjligt att skaffa individuella tillstånd från alla rättighetshavare.
Utredaren ska bland annat titta på frågan om en eller flera
organisationer bör kunna träffa sådana avtal.
* Slutligen ska utredaren se över hela upphovsrättslagen i
redaktionellt och språkligt hänseende.
Utredningen i sin helhet ska redovisas senast den 31 oktober 2010.
Utredaren ska i sitt arbete samråda med berörda intressenter, bland
annat branschorganisationer och arbetsmarknadens parter.
Jan Rosén är professor i civilrätt vid Stockholms universitet med
särskild inriktning mot upphovsrätt. Han har bland annat skrivit boken
"Upphovsrättens avtal" som behandlar grundfrågorna vid överlåtelse och
upplåtelse av upphovsrätt. Jan Rosén är även ledamot av regeringens
IT-råd. Han tillträder uppdraget som utredare den 1 maj 2008.
