FSFE, Samba: Un triomphe pour la liberté de choix et de concurrence
"Microsoft ne peut plus se considérer au-dessus de la loi dorénavant," dit Georg Greve, président de la Free Software Foundation Europe (FSFE).
"Microsoft a réussi, par des tactiques qui ont réussi à enrayer avec succès les mécanismes antitrust dans d'autres parties du monde, y compris aux États-Unis, à repousser ce jour depuis presque dix ans. Mais grâce à la persévérance et à l'excellent travail de la Commission Européenne, ces tactiques ont désormais échoué en Europe," continue Greve.
Carlo Piana, conseiller juridique de la FSFE: "La FSFE et l'équipe Samba saluent la décision de la cour. Un pas a été franchi pour la libre concurrence. Cela met un terme à l'idée que l'opacification délibérée des standards et le verrouillage programmé puissent constituer des modèles économiques acceptables, et force Microsoft à revenir à la libre concurrence dans le domaine de la technologie des logiciels."
"L'équipe Samba aimerait remercier la Commission Européenne pour son travail extraordinaire de ces dernières années. Des millions d'utilisateurs de part le monde vont récolter le fruit de leur travail," commente Jeremy Allison, coauteur du projet Samba. "Ceci est un jour important pour l'équipe Samba: nous espérons pouvoir enfin entrer en compétition de façon équitable, sans qu'on nous refuse l'accès aux informations nécessaires pour assurer l'interopérabilité. Samba sera alors dans la mesure d'offrir un choix véritable, avec tous les bénéfices de liberté de logiciel."
Volker Lendecke de l'équipe Samba: "Maintenant que la cour a pris sa décision, nous allons surveiller de près quels seront les termes de licence exacts utilisés pour les informations d'interopérabilité. Il sera très important de s'assurer que cet information pourra être utilisée dans des Logiciels Libres, sinon le grand succès obtenu par la Commission serait sévèrement endommagé. Samba est l'un des acteurs les plus importants dans le marché des serveurs collaboratifs, le marché dans lequel la Commission veut rétablir la libre concurrence."
"Ceci est un très bon jour pour l'Europe, mais il ne s'agit que d'un pas sur le chemin. Le thème récurrent dans le comportement de Microsoft ces dernières années est qu'ils perçoivent manifestement l'interopérabilité comme un danger à combattre," résume le conseiller juridique de la FSFE, Carlo Piana. "Le dernier exemple nous a été donné par MS-OOXML que Doug Mahugh de Microsoft a décrit comme une réponse commerciale à la menace que représente le standard ISO ODF et l'interopérabilité offerte par ce dernier. Ce sont donc des considération non pas techniques mais tactiques qui ont motivé les efforts globaux de manipulation des instances nationales de normalisation les conduisant à accepter MS-OOXML les yeux fermés."
Le président de la FSFE Greve conclut: "La décision d'aujourd'hui a posé un précédent important pour le futur. La manipulation secrète de formats et de protocoles ouverts ont été clairement désignés comme inacceptables. Nous encourageons maintenant la Commission Européenne à considérer la plainte antitrust soulevé récemment par l'ECIS. Dans un effort commun avec l'équipe Samba et OpenOffice.org, la FSFE se fait un plaisir d'offrir son expertise à la Commission Européenne sur ce cas.
