Čeprav to po Evropi ni ravno tipičen primer, ni osamljen — npr. vsaj en kanton v Švici ima zelo podoben problem.
Res je, da v taki situaciji ne bomo kmalu premaknili gore, ampak dolgoročno pa vseeno lahko vplivamo na mentaliteto, da se bodo najprej zavedali problema priklenitve (lock-in).
Tu nam tudi konkretno pride prav EU — poleg pravno ne-zavezujočega EIF[1], obstajajo tudi pravno zavezujoča pravila, ki se jih lahko posredno uporablja. Gre npr. za določbo, da se pri javnih naročilih ne sme sklicevati na samo enega ponudnika ali rešitev ipd. Na tej podlagi je možna tudi pritožba na Evropsko Komisijo [EC], ki sproži potem postopek (pred Sodiščem Evropskih skupnosti [ECJ]) proti državi. Mi je bilo rečeno, da se je tega poslužil (večkrat) že RedHat. Torej se lahko vsaka firma, ki bi drugače bila zmožna prijaviti se na tak javni razpis, posluži te prijave na EC.
