Buongiorno, sono da poco iscritto alla Fellowship, quindi spero di non commettere errori, con questo mio primo messaggio.
Durante la scorsa settimana i media hanno mostrato interesse per il Disegno di legge 2484, attraverso articoli e commenti. Si è messo in particolare evidenza l'articolo 4 ("Libero accesso a software, contenuti e servizi"), ma ho l'impressione che il modo di trattare l'argomento sia stato eccessivamente focalizzato sulle conseguenze che la legge avrebbe per una singola azienda, con relative implicazioni politiche.
Il contenuto della legge, per quel che posso capire, sembra interessante, nonché correlato con le istanze della FSFE. Mi chiedevo, quindi, se esistesse una posizione ufficiale (della FSFE, appunto) a riguardo. In particolare, dopo aver scorso rapidamente i commenti dati dai lettori alla notizia, ho trovato (tra molte obiezioni ed ironie che mi sembrano fuori luogo) un punto che forse ha un fondamento, ovvero la sovrapposizione del DDL a regolamenti europei, ed in generale l'opportunità di agire a livello nazionale su di un tema che andrebbe affrontato in ambito UE.
In conclusione, se qualcuno tra gli iscritti ad Fsfe-it avesse le competenze tecniche per leggere il testo del Ddl, e darne una valutazione, penso potrebbe essere utile.

Una posizione specificatamente sul DDL 2484 non c'è, ma tra gli obbiettivi politici di FSFE c'è la cd. "device sovereignty" che implica il diritto degli utenti di installare e rimuovere software liberamente e in questo è in linea con l'art.4 della proposta di legge.[1]

Credo che chi paventa un eventuale conflitto con norme europee si riferisca all'art. 3 "Limiti alla gestione del traffico" che tocca materie già affrontate da regolamenti europei come la neutralità della rete e l'abbattimento dei costi di roaming.

Mi sembra quindi confermata l'impressione di una certa "affinità" tra gli obbiettivi della legge e le proposte della FSFE. Peccato che, sui giornali e sulla rete, l'argomento sia stato trattato come la prospettiva di una legge che potrebbe vietare ad alcuni particolari produttori la presenza sul mercato italiano, trascurando tutto il resto.

A me non sembra esattamente così...
L'art.4 reca:
"Gli utenti hanno il diritto di disinstallare software e di rimuovere contenuti che non siano di loro interesse dai propri dispositivi, *salvo che tali software siano previsti come obbligatori da norme imperative o siano essenziali per l'operatività o per la sicurezza del dispositivo, delle reti pubbliche di comunicazioni alle quali si connette o dei dati gestiti dal dispositivo. È comunque vietata ogni disinstallazione effettuata al solo fine di consentire al dispositivo di funzionare in violazione di norme imperative.*"
In sostanza, il divieto di disinstallare software e/o contenuti c'è eccome se solo previsto da una qualsiasi "norma imperativa" o per fatto (?) di essere "essenziali per l'operatività o per la sicurezza del dispositivo": fattispecie decisamente vaghe, ampie e che si prestano ad arbitrio...
E ciò che una norma qualifica con "salvo che" diventa sistematicamente la regola... altro che diritto di installare e rimuovere a piacimento!
Si tratta quindi, a mio parere, di una proposta di legge PESSIMA che apre (conferma) scenari MOLTO preoccupanti.
