Genau das war auch mein Gedanke, die Lösung des "Problems" ist doch eigentlich recht einfach... der DWD müsste nur den Quellcode der App unter eine vernünftige Lizenz stellen und veröffentlichen, und könnte für die App im Google/Apple Store dann 2-3 Euro verlangen.
Wenn dann jemand kommt und dafür sorgt dass die App im F-Droid Store landet, ist der DWD außen vor.

Wie es der Zufall will, habe ich die vergangene (schlaflose) Nacht genutzt, um eine Mail an den DWD zu schreiben, in der ich auf die PMPC Kampagne aufmerksam mache und nachfrage, ob man die WarnWetter App nicht unter eine freie Lizenz stellen könnte :D

Ich habe ein Antwort vom DWD bekommen! Der freundliche Herr vom Wetterdienst bezeichnete die Ziele der FSFE und der Kampagne als ehrenwert, konnte jedoch aufgrund des noch laufenden Verfahrens keine genauen Angaben zur Zukunft der App machen. Er versprach jedoch, die Sache mit seinem Vorgesetzten zu besprechen.

Das hört sich gut an und freut mich. Auch wenn der Tenor des Urteils das Gesetz gegen den unlauteren Wettbewerb bemüht, heisst das noch lange nicht, dass dieses Urteil von anderen Instanzen bestätigt wird.
Ich bin kein Rechtsanwalt und mache auch keine Rechtsberatung. Das muss ich schreiben, da ich hier jetzt das Gesetz zitieren möchte.
Für die Tätigkeiten des DWD ist das Gesetz über den DWD massgeblich, hier nachzulesen http://www.gesetze-im-internet.de/dwdg/DWDG.pdf . In Paragraf 4 werden die Aufgaben festgeschrieben. §4.3 ist unstrittig; d.h. der Kläger hat sich nicht gegen diese Formulierungen gewandt.
IMHO richtet sich der Klageqanspruch gegen §4.6
(6) Der Deutsche Wetterdienst darf Leistungen, die im Sinne des § 6 Absatz 2a unentgeltlich zur Verfügung gestellt werden, selbst öffentlich verbreiten, soweit dies zu seinen gesetzlichen Aufgaben gehört.
Hier wurde bestritten, dass eine übliche Wettervorhersage über den Aufgabenbereich hinausgeht.
In Paragraf 6 ist diese Stelle von Interesse
(2a) Sofern nicht auf Grund anderer gesetzlicher Regelungen eine Pflicht zur Entrichtung von Gebühren besteht, sind folgende Dienstleistungen des Deutschen Wetterdienstes entgeltfrei:
- jene an Bund, Länder und Gemeinden und Gemeindeverbände nach § 4
Absatz 4, 2. jene an die Allgemeinheit nach § 4 Absatz 1 Nummer 3 und 7 zur öffentlichen Verbreitung, 3. die Bereitstellung von Geodaten und Geodatendiensten im Sinne des § 3 Absatz 1 und 3 des Geodatenzugangsgesetzes im Geoportal der nationalen Geodateninfrastruktur.
Im Übrigen sind die von der WetterApp bereitgestellten Informationen kostenlos auf den Internetseiten des DWD abzurufen. Das wurde nach meiner Kenntnis nicht gerügt.
Sollte das Urteil Bestand haben oder vom DWD anerkannt werden, bleibt wohl nach derzeitigem Stand die Webseite als Informationsquelle übrig. Da genügt ein einfacher Browser. Das ist halt keine App für's Smartphone.
