ich habe die Anwendung http://openmeetings.googlecode.com (maßgeblich) entwickelt. wie ich .. durch ein Gespräch mit einem Kunden entdeckt habe benutzt ein *Wettbewerber* persony.com teile (oder auch mehr, das konnte ich noch nicht ermitteln) der Anwendung, wie ich hier dokumentiert habe: http://wagner-sebastian.com/wordpress/2009/01/08/personycom-is-using-openmee...
und verkauft das ganze als ihre Anwendung.
Persony verwendet modifizierte Teile von OpenMeetings, ohne dabei den Source Code zu veröffentlichen und ohne LPGL oder GPL dafür zu verwenden.
was kann ich jetzt machen?
an gpl-violation hab ich bereits geschrieben auch. Ich hab aber nicht den Eindruck als dass von der Seite bald etwas passieren würde.
Persony.com hat mit bisher auch nicht geantwortet.

Afaik sollte man bei solchen Sachen sehr vorsichtig formulieren; zu schnell hat man heutzutage eine Klage wegen geschäftsschädigenden Verleumdungen am Hals. Die Liste hier wird öffentlich archiviert... Mir ist gerade aufgefallen, dass du das auch schon verblogt hast. Nur weil die Screens sich ähneln heißt es noch lange nicht dass dein Code da mit drin steckt. Lieber erstmal auf Nummer sicher gehen... Prinzipiell musst du dein Vorgehen mit deinen Zielen koordinieren: zwischen "in Zukunft halten sie die LGPL ein" und "Ich will Schadensersatz für vergangene Verfehlungen" ist ein weites Feld. Prinzipiell wäre Schritt 1 Beweise sammeln. Schritt 2: Kommt darauf an, wie hart du gegen die vorgehen willst. Zwischen einer Email an den CEO mit der Aufforderung, innerhalb von X Tagen eine für dich akzeptable Lösung zu finden und direkt einer Klage in Kalifornien ist alles drin. Einer der Partner ist sogar in Deutschland; wenn du also den Weg in die USA scheust kannst du auch an deutschen Gerichten dein Glück versuchen (aber damit prinzipiell einen Unschuldigen treffen).
Du kannst auch einfach versuchen, so viel schlechte Publicity zu generieren, dass persony zum Handeln gezwungen ist.
In meinen Augen solltest du persony erstmal anschreiben und ihnen zwei Wochen zu einer Einigung geben (sofortige Einhaltung der LGPL + X Dollar Schadenersatz). Bist du eigentlich der einzige Entwickler oder gibt es noch andere Leute, die Code beigesteuert haben? Liebe Grüße, Florian Haas

=> ja persony hat mir mittlerweile geantwortet dass sie niemals sowas tun würden und mich in diesem sinne auch auffordern sämtliche verlinkungen zu sich zu löschen und mein äußerungen zurückzuziehen.

Zu deinem Problem: Verletzt persony.com konkret die LGPL? Bei deinen bisherigen Punkten konnte ich keine direkte verletzung feststellen. Nutzen Sie dein Programm als Bibliothek im kombinierten Werk mit eigenem Hauptprogramm? Nutzen Sie eine modifzierte Variante deines Codes? Geben Sie die entsprechenden teile unter LGPL/GPL weiter? Nennen Sie deinen Namen? Schränken Sie die Nutzung ein?

ein Blick ins Gesetz hilft bei der Rechtsfindung:
§3. Sie dürfen das Programm (oder ein darauf basierendes Werk gemäß Paragraph 2) als Objectcode oder in ausführbarer Form unter den Bedingungen der Paragraphen 1 und 2 kopieren und weitergeben – vorausgesetzt, daß Sie außerdem eine der folgenden Leistungen erbringen:
1. Liefern Sie das Programm zusammen mit dem vollständigen zugehörigen maschinenlesbaren Quelltext auf einem für den Datenaustausch üblichen Medium aus, wobei die Verteilung unter den Bedingungen der Paragraphen 1 und 2 erfolgen muß. Oder:

Liefern Sie das Programm zusammen mit einem mindestens drei Jahre lang gültigen schriftlichen Angebot aus, jedem Dritten eine vollständige maschinenlesbare Kopie des Quelltextes zur Verfügung zu stellen – zu nicht höheren Kosten als denen, die durch den physikalischen Kopiervorgang anfallen –, wobei der Quelltext unter den Bedingungen der Paragraphen 1 und 2 auf einem für den Datenaustausch üblichen Medium weitergegeben wird.

Die GPL zwingt dich nicht, den Quellcode zu veröffentlichen. Die GPL fordert, daß Du Deinem Kunden auf Nachfrage den Quellcode zur Verfügung stellst.
Darüber hat das bei Harald Welte funktioniert. Er war Kunde, da er den Router gekauft hat, und sie haben auf Nachfrage den Quellcode nicht rausgerückt.
Hat einer der Kunden bei der Firma schon mal nach dem Quellcode gefragt ? Wurde dieses dann abschlägig beantwortet ? Dann könnte dieser Kunden dagegen vorgehen.
Die GPL soll die Freiheit des Users schützen.

Auch in dem Fall muss der Rechteinhaber gegen die "Firma" vorgehen, der Kunde wäre dann aber ein Zeuge der Lizenzverletzung.

Ja, und die Freiheit aller (also auch der Entwickler und Gesellschaft) ingesamt.
Sebastian, mein Rat wäre einen Anwalt zu engagieren. Er sollte in den Fragen Urheberrecht, Freie Software und ggf. FS internationale Gemeinschaft erfahren sein.
Du sparst Dir eine Menge Zeit und bekommst verläßliche Anworten. Die Anwältin kann für Deine Strategie: Lizenzeinhaltung entsprechende Handlungsvorschläge machen und die ggf. auch durchführen. In der Regel sind die Kosten sehr überschaubar.
