Ich habe eine grundsätzliche Frage zu Freier Software im Arbeitskontext, speziell wie man es ermöglichen kann, dass ich als Arbeitnehmer im Rahmen meiner Arbeitszeit Freie Software entwickeln kann, ohne Probleme zu bekommen. Ich weiß nicht, ob das eine triviale Frage ist, aber ich habe bisher noch keine Antwort bei meiner Recherche bekommen.
Mein Arbeitsvertrag (wie die meisten deutschen Arbeitsvertrag) enthält das exklusive, übertragbare Nutzungsrecht für meinen Arbeitgeber über alle meine Arbeitsergebnisse. Darunter fällt natürlich auch Quellcode.
Angenommen, dass ich nun ein Stück Software entwickele, das unter einer freien Lizenz (GPL, Apache, egal) veröffentlicht werden soll. So weit ich Freie Software verstehe, basieren GPL und Co. auf dem Urheberrecht, also einem Recht, das ich nicht an meinen Arbeitgeber abgetreten habe (und auch nicht abtreten kann). Das bedeutet, dass nicht mein Arbeitgeber die Software unter GPL veröffentlichen kann, sondern nur ich. Problem (so wie ich es verstehe) ist aber, dass ich keine Nutzungsrechte mehr an dieser Software habe und sie dementsprechend nicht veröffentlichen darf.
Meine laienhafte Interpretation der Situation ist daraus, dass ich mir von meinem Arbeitgeber ein Nutzungsrecht einräumen lassen muss, diese Software unter GPL zu veröffentlichen. Ist meine Interpretation korrekt? Wenn ja, gibt es für solche Sondervereinbarungen Vorlagen, die mir solch ein Nutzungsrecht einräumen?
Ich bin absoluter Laie auf dem Gebiet des Urheber- und Arbeitsrecht, daher ist das auch alles mit Vorsicht zu genießen was ich schreibe. Ich lasse mich gerne von euch korrigieren und aufklären! Ich bin sehr interessiert an euren Erfahrungen und Einschätzungen.

Die GPL basiert auf dem amerikanischen Copyright welches unseren ausschließlichen Nutzungsrechten basiert. Diese können übertragen werden. Zusätlich gilt noch § 69b UrhG.
"Wird ein Computerprogramm von einem Arbeitnehmer in Wahrnehmung seiner Aufgaben oder nach den Anweisungen seines Arbeitgebers geschaffen, so ist ausschließlich der Arbeitgeber zur Ausübung aller vermögensrechtlichen Befugnisse an dem Computerprogramm berechtigt, sofern nichts anderes vereinbart ist."
Der Arbeitgeber ist aber verplichtet Urheberrechte Dritter nicht zu verletzen. Bei einer GPL Verletzung haftet dann der Arbeitgeber und muss mit Unterlassungsklagen rechnen. Verändere ich ein Programm das unter der GPL steht so ist es mir erlaubt diese zu veröffentlichen, der Arbeitgeber hat dann keine ausschließlichen Nutzungsrechte.
Ist der Arbeitgeber eine Universität so sind die Chancen in Deutschland häufig besser freie Software zu entwicklen, so hat z.B. der Professor welcher meine Bachelorarbeit betreut hat, freie Software unter der BSD-Lizenz veröffentlicht. Auch ich bin momentan auf der Suche nach einem Arbeitgeber welcher mir erlaubt meine Software als freie Software zu veröffentlichen. Dies ist z.B. bei der Equipe Décentralisé[1] der Fall.

Tun sich Hochschulen immer noch so schwer, jedermann ein einfaches Nutzungsrecht einzuräumen? In der Vergangenheit gab es regelmäßig Probleme, weil die Sorge vorherrschte, daß auf diese Weise Drittmittel verlustig gehen könnten.
In der Privatwirtschaft kann das viel einfacher sein (muß aber nicht).

Das würde ich nicht ohne Weiteres stehenlassen. Der Arbeitnehmer ist in diesem Fall aus meiner Sicht nicht der Lizenznehmer und hat daher auch keine Rechte. Der Lizenznehmer hat wiederum keinerlei Verpflichtung, Code zu veröffentlichen.

Oh, das hatte ich übersehen. Ja, es ist zutreffend, daß man nicht einfach so Code veröffentlichen darf, nur weil er von anderem Code abgeleitet ist, der der GPL unterliegt. Das gilt selbst für den Fall, daß mit der Weitergabe des Quellcodes eine GPL-Verletzung geheilt würde (weil dadurch eine neue Urheberrechtsverletzung begründet wird). Die Zustimmung der Rechteinhaber ist erforderlich.

Diese Regelung enthält Grenzen, die oft nicht leicht zu kontrollieren sind. Daher haben manche Arbeitgeber das Bedürfnis, eine umfassendere Regelung in die Arbeitsverträge zu schreiben, was bei Menschen, die in ihrer Freizeit Freie Software schaffen, zu Problemen führen kann.

Die Copyleft-Pflichten des Lizenznehmers entstehen erst mit der Weitergabe oder Verbreitung der Software. Beauftragt ein Arbeitgeber einen angestellten Programmierer damit, eine GPL-lizenzierte Software an die betrieblichen Bedürfnisse anzupassen, ist es allein Sache des Arbeitgebers, darüber zu entscheiden, ob dieses abgeleitete Werk verbreitet werden soll oder nicht. Erst wenn es verbreitet wird, treffen den Arbeitgeber die Pflichten aus der GPL.
Diese Erläuterungen dienen lediglich der allgemeinen Bildung und Information, nicht aber der Beratung bei individuellen rechtlichen Anliegen. Eine Nutzung dieser Erläuterungen im Einzelfall erfolgt auf eigene Gefahr.
Es ist in Erwägung zu ziehen, sich wegen Ihres konkreten Anliegens an einen Rechtsanwalt oder an eine zur Rechtsberatung befugte Beratungsstelle zu wenden!

Ich habe das ganze dann für mich gelöst, in dem ich bei meinem Arbeitgeber eine Nebentätigkeit pro Projekt angezeigt habe. Da Nebentätigkeiten (zumindest bei uns) relativ häufig vorkommen, hat mein Arbeitgeber dafür fertige Formulare/Prozesse. Die habe ich verwendet: einfach eingetragen an welchen Projekten ich arbeite (kurz die Ziele des Projektes erläutert) und welchen Zeitumfang ich dafür ungefähr ansetze. Das ganze ist dann von meinem Vorgesetzten sowie der HR Abteilung unterschrieben worden.
Damit fühle ich mich auf der sicheren Seite, denn mein Arbeitgeber weiß nun offiziell (und in der Personalakte vermerkt, ich habe auch eine unterschriebene Version der Genehmigung), dass ich Freie Software entwickle.
Kritisch sollte es eigentlich nur werden, wenn man sich an Projekten beteiligt, die in Konkurrenz zum Arbeitgeber stehen.

Hm, das ist schade und ich dachte, das wäre ein relativ normaler Vorgang. Gibt es vielleicht Beispiele, bei Unternehmen wie Red Hat und Co., wo das Hauptprodukt bereits Freie Software ist?

Du irrst nicht. Mir ging es darum, die rechtliche Situation von für Dinge zu klaren, die ich außerhalb der Arbeitszeit erstelle. Bei unseren flexiblen Arbeitszeiten und breitem Arbeitsbereich ist das nicht einfach zu trennen.
Für Software, die ich in meiner Arbeitszeit entwickle, hat mein Arbeitgeber einen eigenen Prozess. Prinzipiell muss ich bei der Beantrage der Freigabe als OSS - begründen, warum die Freigabe als Free Software vorteilhaft ist, -um was für eine Software (Anwendungszweck, Größe, Anzahl Contributor, etc.) es sich handelt, - wie veröffentlicht werden soll (Community des Arbeitgebers, github, etc.) - welche Abhängigkeiten die Software hat und welche Lizenz vorgesehen ist.
Anschließend wird der Antrag vom Arbeitgeber überprüft. Unter anderem beinhaltet die Überprüfung, ob die Lizenzen (der Abhängigkeiten sowie der eigenen Entwicklung) kompatibel sind. Idealerweise bekomme ich nachher die Freigabe - das sind aber alles interne Prozesse - es handelt sich ja um eine Entscheidung des Arbeitgebers, wie er etwas veröffentlicht das ihm gehört.

Es handelt sich dabei um komplett neue Software, nicht um Software, die auf einer anderen GPL-lizensierten Software aufbaut.
Für mich ist die Frage, wie ich die Nutzungsrechte von meinem Arbeitnehmer eingeräumt bekomme und ob es für solch einen Vorgang Musterverträge gibt.

Hallo Philip,
so wie ich das verstehe liegt das Urheberrecht somit komplett bei Deinem Arbeitgeber. Die SW wäre damit "© $Arbeitgeber", aber wenn Du vereinbart bekommst, daß Du sie unter FLOSS-Lizenz X veröffentlichen darfst, ist er für dieveröffentlichte Version des Codes praktisch "nur noch" Lizenzgeber. Diese Lizenzen lassen sich ja nicht widerrufen ;) Natürlich kann er mit dem Code immernoch alles machen, was er will, aber die veröffentlichte Version bleibt frei und evtl darfst Du sogar in Deiner Arbeitszeit daran weiterbasteln.
Wenn ihr grob in dem Gebiet arbeitet, aber Du nur ein nützliches Tool gebastelt hast, das dem Anspruch einer Patentierung nicht genügt (recht offensichtliche Lösung, auf die jeder mit dem Fachwissen kommen kann) würde ich argumentieren, daß Dein AG damit demonstriert, daß er kompetente Mitarbeiter auf dem Gebiet hat. Alle meine OpenStack bezogene Arbeit und große Teile meiner SaltStack Beiträge sind © TU Berlin & FhG FOKUS, aber unter Apache-Lizenz auf Github* (womit ich sehr glücklich bin). Für meine Abteilung ist das Promotion: "Schaut mal, Telcos, ihr wollt unser LTE-Backend auf OpenStack testen? Wir kennen OpenStack gut genug, um es automatisiert auszurollen!"

Grundregel: Alles, was in der Arbeitszeit entsteht, gehört Deinem Arbeitgeber. Entsprechend braucht es eine Vereinbarung, dass Du es veröffentlichen darfst.
Am besten darüber mit dem Vorgesetzten sprechen. Musterverträge kenne ich persönlich nicht, da ja alles was Du machst im Grunde Aufträge des AG sind.

INAL aber ich gehe davon aus, dass wenn es nicht explizit geregelt ist, Sachen die auf Arbeit geschrieben werden, Auftragswerke für den Arbeitgeber sind und mit einer ausschließlichen Lizenz für den AG versehen werden. Fairerweise muss ich sagen, dass dies bei meinen Verträgen in Vergangenheit immer geregelt war genau im oberen Sinne. (Im Zweifel kann man es ja durch Induvidualregelungen überschreiben)

Korrekt, er allein kann das Werk wirtschaftlich verwerten.
Daher frage ich, ob nur ich dann die Software veröffentlichen kann oder die Interpretation der GPL auch diese Nutzungsrechte verwenden kann .
Eine Veröffentlichung unter der GPL greift ganz wesentlich in die wirtschaftliche Verwertung ein, so daß der Inhaber der Nutzungsrechte auf jeden Fall zustimmen muß.
Grundsätzlich würde ich an Deiner Stelle darauf hinarbeiten, daß der Arbeitgeber das Werk veröffentlicht.
