So, ich diskutiere immernoch mit Dell über diesen Fall. Für das erste Notebook ist es leider gegessen, weil ich nicht nachweisen kann, dass ich das Formular tatsächlich rechtzeitig abgeschickt hat.
Das 2. ist kaputt gegangen weil ein anscheinend teilweise defekte USB-Maus an den Laptop angeschlossen wurde. Wurde mir ersetzt. Und genau darum geht es jetzt. Hat man bei einer Nachbestellung kein Widerrufsrecht? In der Email war folgendes vorhanden:
Die Bestätigung Ihrer letzten Dell-Bestellung ist beigefügt - welche Ihnen nicht in Rechnung gestellt wird.
Das voraussichtliche Lieferdatum für diese Bestellung ist am oder vor dem 2011-01-03.
Angehängt war einmal eine Auftragsbestätigung in der unter anderem steht:
"Neue Auftragsbestätigung ersetzt frühere"
Dann steht da als Auftragsdatum:
Auftragsdatum 16.12.2010
Anbei war einmal auch die AGB mit erneuter Widerrufsbelehrung
Ich habe sie erst angeschrieben als das die Nachbestellung da war, also am 23.12.2010. Mein Widerrufsrecht galt laut Dell-Dame bis zum 20.12.2010, weil es auf die Nachbestellung kein Widerrufsrecht gab.
Was meint ihr, ist das rechtens?
