Heute bin ich auf zwei blog-Beiträge gestoßen:

Es geht um die Position von Linus Torvalds, daß die Durchsetzung der GPL Code-Beiträge von Unternehmen behindern würde.
Wenn ich ihn richtig verstehe, folgt Jonas Öberg dieser Position, weil er zu recht meint, daß 99% der Nutzer den Code nicht untersuchen können und das Hauptinteresse haben, daß sie "guten" nutzen können. Damit erklärt er faktisch die Freiheiten drei und vier für unbedeutend für 99% der Nutzer. Es überrascht mich doch sehr, daß ein wichtiger Vertreter der FSFE diese Position vertritt.
Aus meiner Sicht sollte die FSFE mal klären, welche Bedeutung denn die vier Freiheiten für 99% der Nutzer haben.

Aus heutiger Sicht würde ich das zu den Freiheiten 1 und 2 Gesagte anders formulieren, das zu den Freiheiten 3 und 4 formulierte aber nicht:
Als Teil der 99%, die den Quellcode nicht verstehen, will sicher sein, daß der Quellcode von UNABHÄNGIGEN Fachleuten studiert werden kann und jeder, der es kann, ihn verändern kann. Es ist für mich deshalb nicht akzeptabel, wenn Firmen den Quellcode zurückhalten und damit schleichend die z.B. die Entwicklung des Kernels (weiter?) übernehmen. Es wäre töricht zu glauben, daß sie dabei andere als ihre Geschäftlichen Interessen im Blick haben; und die sind nicht deckungsgleich mit den Interessen der 99% der Nutzer.
Darauf zu bestehen, daß auch Firmen sich an die GPL oder jede andere Freie Lizenz halten, hat für mich Nichts mit Gewalt ("Force") zu tun. Es wird in dieser Gesellschaft ja auch durchgesetzt, daß man z.B. nicht stehlen darf; zur Not mit strengen Strafen.

Ich verstehe seinen Text so, dass 1% der Nutzer den Linux-Kernel selbst patchen können, um einen defekten Hardware-Treiber eigenhändig zu reparieren (und ich persönlich würde da 1% noch als eher hoch gegriffen ansehen), während 99% der Nutzer sich wünschen, dass der Hardware-Hersteller aktiv mit den Kernel-Entwicklern zusammenarbeitet und somit im Standard-Kernel bereits ein qualitativ guter und funktionierender Treiber enthalten ist.
Es ist naturgemäß so, dass Unternehmen ihre geschäftlichen Interessen im Auge haben, aber glücklicherweise gibt es auch Unternehmen, die erkannt haben, dass es tatsächlich in ihrem geschäftlichen Interesse ist, wenn die Hardware, die sie verkaufen, auch unter Linux (sic!) out-of-the-box funktioniert.

Ich denke, man sollte um Klarheit zu gewinnen, verschiedene Fragen unterscheiden.
1. Welche Bedeutung haben die vier Freiheiten jeweils für den Nutzer?
In der Tat dürften beim Linuxkernel 99% seiner Anwender, die Freiheit ihn zu verbessern, nicht aktiv nutzen. Das aber bedeutet keineswegs, dass diese Freiheit für sie keine Bedeutung hat.
2. Will man Copyleft? Wenn ja, warum? Und: Welche Bedeutung hat das Copyleft? Für die Entwickler? Für die Anwender?
3. Wenn man Copyleft befürwortet: Wie soll das Copyleft im Verletzungsfall durchgesetzt und verteidigt werden?
4, Wie verhält man sich zu Menschen, die eine andere Auffassung hinsichtlich der Durchsetzung des Copylefts haben?

Grundsätzlich muss er das; ob und wie die Durchsetzung erfolgt, hängt aber davon ab, wie streng der Geschädigte das Ganze sieht. Beispielsweise ist Beamtenbeleidigung eine Straftat, trotzdem hören viele Polizisten meistens einfach weg.
Bei Lizenzen gehe ich aber davon aus, dass der Rechteinhaber die Lizenz absichtlich ausgewählt hat und daher vermutlich auch einen gewissen Wert auf das Copyleft legen wird. Ich kann mir aber auch hier vorstellen, dass der Rechteinhaber, wenn keine bösen Absichten hinter der Lizenzverletzung stehen und dem Rechteinhaber kein nennenswerter Schaden entsteht, auch ein Auge zudrücken kann.

Auch bei der Durchsetzung der Lizenzbedingungen gibt es zwischen "Augezudrücken" und sofortiger anwaltlicher Abmahnung mit anschließender Klage eine gewisse Bandbreite an Reaktionsmöglichkeiten.

Für fast 100% der Smartphone-Nutzer sind die 4 Freiheiten bedeutungslos:
Es gibt kein Hindernis, die mitgelieferte Software beliebig zu verwenden. Software kopieren zu können ist überflüssig. Sie wird ja mitgeliefert oder kann kostenlos oder gegen einen kleinen Beitrag aus dem App-Store geholt werden. Die Offenheit des Quellcodes ist entbehrlich. Den kann sowieso keiner verstehen. Die Möglichkeit der Änderung entfällt damit für fast 100% auch.
Als weg mit der GPL und anderen Freien Lizenzen und zurück zur proprietären Software und Auflösung der FSF(E).
Die Bedeutung der vier Freiheiten erschließt sich dem "normalen" Nutzer nicht, es nützt auch kaum was, wenn sie immer wieder wiederholt werden. Man kann nur mit den indirekten Vorteilen argumentieren, die aus meiner Sicht aber nur voll wirksam werden, wenn alle sich an die Lizenzen halten (müssen); auch Weltfirmen.
Noch eines zu Copyleft. Die vier Freiheiten ergeben sich fast direkt aus den Eigenschaften von Software (z.B. rivalitätsfreie Nutzung möglich). Man muß Zwangsmaßnahmen ergreifen, um aus Software eine Ware zu machen. Die eigentliche Leistung von Richard Stallman ist für mich die Erfindung des Copylefts, die sich nicht daraus direkt ergibt und die Freiheit von Software sichert. Deshalb bin ich für das Copyleft.
