nachdem ich dazu noch nichts auf den FSFE-Listen gesehen habe, werfe ich es mal hier in die Runde.

Seit gestern ist eine neue TOS von Github in Kraft getreten, die offenbar grobe Probleme mit Copyleft Lizenzen verursacht.
Hat sich schon jemand genauer damit befasst was es damit auf sich hat? Ich bin nicht sehr bewandert in juristischen Dingen und kann es selbst nicht beurteilen.

Ja, auf unserer englischsprachigen Diskussionsliste wird seit gestern Abend ein bisschen darüber geschrieben [1]. Dort wurden die Wogen etwas geglättet und u.a. dieser Link mit den Aussagen eines mutmaßlichen Anwalts sorgt wohl für erste Entspannung: https://news.ycombinator.com/item?id=13768188

So wie ich das sehe ist das ein so nicht gemeintes Mißverständnis bzw. nur eine explizitere Klärung, dass bei allem was du auf du Github "hochlädst" du natürlich Github die Rechte dazu gibst das entsprechend (je nach eingestellter Berechtigungen) anderen zur Verfügung zu stellen. Diese Rechte musstest du ihnen auch schon früher mindestens implizit einräumen, dh. es war "schon immer ein Problem" wenn du Code von Dritten in der Form veröffentlicht hast, und ist jetzt nur expliziter formuliert. Oder man sieht es halt nicht als Problem. Ist ja sowieso freundlich wenn man Leuten vorher zumindest Bescheid gibt bevor man 'ihren' Source auf proprietäre Plattform XYZ hochlädt.
Das wird jetzt auch nicht so einfach zu (er)klären sein, gerade bei einer international doch etwas anderen Rechtsauslegung ist das nicht straightforward, und wenn die Amis zu irgendeinem Schluss kommen heißt das noch nicht dass das woanders dann auch so wäre.
