Wenn also das Angebot unterbreitet wird, einen Lizenzvertrag zu den Bedingungen der GPL abzuschließen, und dieses Angebot wird von N.N. angenommen, dann hat der Lizenzgeber die Pflicht den Quellcode zur Verfügung zu stellen, so wie die GPL es von ihm fordert, und der Lizenznehmer hat das Recht, den Quellcode vom Lizenzgeber einzufordern.
Anders wäre die Rechtslage dann, wenn das Angebot lautete: GPL, aber kein Anspruch auf den Quellcode. Dies wäre allerdings ein recht widersprüchliches Angebot und würde nicht nur das Recht zum Studium und zur Verbesserung der Software ausschließen, sondern auch das Recht zur Verbreitung, denn der Lizenznehmer wäre seinerseits außer Stande, die Bedingungen der GPL einzuhalten.
