Ich erinnere mich grob an den Fall Sveasoft.
Mit dem Kürzel "FSE" meinst Du wahrscheinlich die FSF Europe, nehme ich mal an. (Falls dem nicht so ist, so sei der Rest der Mail null und nichtig.)
Soweit ich den Fall überblicken kann, ist Sveasoft rein rechtlich nichts anzuhaben.
Sveasoft behauptet IIRC, die FSF _Nordamerika_ wäre einverstanden mit ihrem Geschäftsmodell, eine kurze Google-Suche verrät aber, dass es sich nicht um ein Einverständnis oder gar eine Unterstützung dieses Geschäftsmodells bedeutet, sondern nur eine Auskunft, dass es nicht gegen die GPL verstößt (http://www.dslreports.com/speak/print/default;10821851).
Wenn das Geschäftsgebahren dieser Firma dem entspricht, was auf der von Dir genannten Website beschrieben, gleichzeitig aber GPL-konform ist, hilft nur Aufklärung der technischen Community, die bekanntlich gut vernetzt ist und sich gegenseitig informiert.
Man könnte die GPL noch so ausgefuchst gestalten -- irgendjemand wird immer irgendeine Lücke suchen und finden. Diese muss nicht notwendigerweise in der GPL selbst liegen (hier gibt es auch kein Problem mit der GPL, soweit ich sehen kann), sondern an Nebenverträgen (in diesem Fall Support und "Early Access"). Hier ist eben ein solcher Fall eingetreten. Verträge muss man (zumindest theoretisch) lesen. Wer sich dabei objektiv oder subjektiv reinlegen lässt, kann sich nicht auf seine Unwissenheit über die Klauseln berufen.
Es tut mir wirklich leid, dass wir hier wohl wenig tun können. Nachdem Du aber auf die öffentliche Liste geschrieben hast, werden öfters Leute bei Google über die Beiträge stolpern und so einen Zugang zu der Sveasoft-Problematik erhalten.
