Diese Art von Hürden sind, so man ihnen keine Strategie unterstellen möchte, 1:1 Anforderungen an Ausschreibungen, die proprietäre Software einkaufen. Der damit entstehende Vendor-Lock-in macht es in jedem irgendwie auf Fortbestand angelegte Einrichtung notwendig, dass die Dienstleister/Zulieferer die nötige wirtschaftliche (und personelle) Stabilität bieten können. Das Ganze wird dann oft noch mit Maßnahmen wie der Hinterlegung des Quellcodes bei Notaren für den Fall des Konkurs garniert.
Genau hier zeigen sich aber die Vorteile Freier Software. Der Code ist bereits im Haus. Es gibt keinen Lock-in, auch nicht bei Individualsoftware. Wenn die Erstellende/Implementierende Instanz baden geht oder einfach keine Kapazitäten hat um Feature X zu implementieren oder Bug Y zu beseitigen, dann kann man, so es keine Exklusivitätsvereinbarungen gibt, jederzeit jemand anderes damit beauftragen. Ich finde, dass genau diese Punkte im Zusammenhang mit der Forderung nach stärkerer Ausrichtung von Ausschreibung auf Freie Software auch stärker hervorgehoben werden müssen. Freie Software ist nunmal keine Alternative Form von proprietärer Software sondern ein ganz eigenes Konstrukt, dem rechtlich und Rechnung getragen werden muss.
Allerdings, dass möchte ich betonen, sind Aspekte wie Sicherheitskonzepte, Compliance, Governance auch bei Freier Software wichtig. Genau hier sehe ich bei vielen kleineren Anbietern, die sich eher auf die Softwarelösung konzentrieren noch oft Handlungsbedarf. Andererseits haben wir mit Sernets Verinince bereits einen tollen Player im Boot um die größten Schwierigkeiten zu adressieren.
