Euroopan parlamentti hyväksyi voimakkaasti viallisen yhtenäispatentin ja luopuu vallastaan innovaatiopolitiikassa

Euroopan parlamentti on tänään hyväksynyt esityksen, jolla muodostetaan yhtenäinen patentti Euroopassa. Päätös synnyttää patenttijärjestelmän, joka on sekä viallinen ja mahdollisesti yliampuva. Samalla demokraattinen kontorolli Euroopan innovaatiopolitiikasta päättyy.
"Olemme pettyneitä, että niin moni parlamentin jäsen oli valmis jättämään euroopan tutkijat ja innovaattorit heitteille saavuttaaksen poliittisen sopimuksen, minkä tahansa sopimuksen" sanoo Karsten Gerloff, Free Software Founation Europen (FSFE) pääjohtaja. "On luonnollista, kun yhtenäisestä patentista on keskusteltu lähes neljä vuosikymmentä, useat keskusteluun osallistuneet halusivat yksinkertaisesti päättää väittelyn. Mutta odotimme enemmän vaaleilla valituilta edustajiltamme."
Voimakasta kritiikkiä kaikilta suunnilta
Hyväksyessään esityksen, parlamentin jäsenet päättivät hylätä voimakkaan kritiikin, jota kaikilta keskustelun puolilta esitettiin. Patenttilakimiehet, itsenäiset oikeudelliset asiantuntijat, pk-yritykset ja kansalaisjärjestöt kuten FSFE toivat esille kritiikin parlamentin jäsenille. FSFE antaa tunnustusta sillä tärkeälle työlle, joita eräät parlamentin jäsenet - erityisesti Vihreät/EVA - tekivät informoidessaan kolleegojaan esityksen vakavista virheellisyyksistä.
Tällä päätöksellä Euroopan parlamentti on tosiasiassa luopunut vallastaan määritellä Euroopan innovaatiopolitiikkaa. Valta siirtyy Euroopan patenttivirastolle, joka on osoittanut myöntävänsä monopolioikeuksia laajimmalla mahdollisella tavalla.
"Olemme huolestuneita siitä, että sekä lainsäädännölliset että täytäntöönpanevat valtaoikeudet siirtyvät yhdelle virastolle" sanoo Karsten Gerloff. "Valtaoikeuksien jako on fundamentaalinen demokratian periaate. Olemme pahoillamme siitä, että tämänpäiväisessä äänestyksessä useat parlamentin jäsenet olivat valmiita luopumaan tästä huonon kompromissin hyväksymiseksi."
Ohjelmistopatentit, hajautuminen ja sekaannus
Tänään hyväksytty päätöslauselma johtaa tuomioistuinten toimialueiden ja päätöskäytännön hajautumiseen ympäri Eurooppaa. Lauselma luo hajaantumista ja sekaannusta sekä tekee patenttijärjestelmän ymmärtämisen paljon hankalammaksi pk-yrityksille. Euroopan patenttivirastolla tulee olemaan vapaammat kädet jatkaa ohjelmistopatenttien myöntämiskäytäntöään. Tämä haittaa kilpailua ja innovaatiota ja luo tarpeettomia riskejä yrityksille ja ohjelmistokehittäjille. Todennäköisesti hyväksytty päätöslauselma johtaa myös voimistuvaan patentteja koskevaan oikeudenkäyntiaaltoon Euroopassa, myös patenttipeikkojen toimesta.
FSFE on myös huolissaan siitä, että esityksestä puuttuvat poikkeus tutkimustoimintaa koskien sekä määräykset pakkolisensseistä. Immateriaalioikeuksiin keskittyneen Max Planck -instituutin mukaan suunniteltu patenttituomioistuin on epäyhteensopiva Euroopan unionin lainsäädännön kanssa. Nämä perustavat virheellisyydet tarkoittavat epävarmuuden jatkumista siitä, miten patenttijärjestelmä tulee toimimiaan tulevaisuudessa.
Seuraavat toimet
Euroopan parlamentin verkkosivujen mukaan "yhtenäisen patenttituomioistuimen luova kansallinen sopimus tulee voimaan 1 tammikuuta 2014, tai kun 13 jäsenvaltiota ovat hyväksyneet sen, edellyttäen, että Yhdistynyt kuningaskunta, Ranska ja Saksa ovat mukana näissä valtioissa. Kaksi muuta päätöstä tulee voimaan 1. tammikuuta 2014, tai kun kansainvälinen sopimus tulee voimaan, sen mukaan kumpi on myöhäisempi. Espanja ja Italia ovat nykyisellään sääntelyn ulkopuolella, mutta voivat liittyä koska tahansa." (suomennus FSFE:n toimesta)

Ehtisikö joku suomentaa FSFE:n alla olevan tiedotteen aiheesta, niin voisin lähettää tiedotteen suomalaiselle medialle? Olen kiinni koko päivän työasioissa, mutta illalla junassa matkalla kotiin voisin lähettää tiedotteen, jos joku ehtii sen siihen mennessä suomentaa...

today at ca. 12:10, the European Parliament adopted a proposal for a unitary patent.
Informed opinion about this proposal has been hostile across the whole spectrum of stakeholders in the patent system.
We've issued a PR (shortly to become available also in Spanish and French, courtesy of Leo and Ana)

The whole proposal is pretty broken, so I'd like to convince myself that there are any number of ways in which it can still fail. More likely, however, everyone will muddle through.
The next formal step is that 13 member states need to ratify this. Germany, France, and the UK have to be among them. If that happens, the unitary patent system will become effective at the beginning of 2014.
Maybe we can get the UK Parliament to throw this out; but that's a long shot.
Otherwise we'll have to come up with new attack vectors.
