At the moment Microsoft pushes out news about failures, so there
really should be a list of successes as the counter-argument.

Keskusteluun kaipaisin mukaan enemmän open source-ihmisiä. Tuolloin
saataisiin mahdollisimman laaja näkemys siitä:
a) millaisia etuja toisi koko julkishallinnon siirtyminen avoimen
lähdekoodin hyödyntäjäksi
b) mitä tuollainen kokonaisen valtion siirtyminen avoimeen
lähdekoodiin merkitsisi yrityksille.
Itsestäni sen verran, että olen työskennellyt ICT-alalla yli 17
vuotta. IT-konsultointiyrityksissä työskentelyn jälkeen siirryin
valtion palvelukseen v. 2008. Tällä hetkellä työskentelen
järjestelmäsuunnittelijana Tikessä, maa- ja metsätalousministeriön
ICT-virastossa. Tike on edelläkävijä valtionhallinnossa avoimen koodin
ratkaisujen hyödyntäjänä. Meillä on erittäin vahva Java- ja
Oracle-osaaminen. Menetelmäpuolella olimme ensimmäisiä julkisia
organisaatioita, joka alkoi hyödyntää Agile-menetelmiä. Scrumia on
käytetty sovelluskehityksessämme vuodesta 2006 alkaen.
Itselläni on työnkuva Tikessä muuttunut useaan kertaan.
Sovelluskehittäjän roolista siirryin testaajaksi
laadunvarmistusryhmään. Tällä hetkellä päätehtäviä ovat
ohjelmistotestauksen ja katselmointien koordinointi sekä
testausmenetelmien kehittäminen.

Euroopan parlamentti on tänään hyväksynyt esityksen, jolla
muodostetaan yhtenäinen patentti Euroopassa. Päätös synnyttää
patenttijärjestelmän, joka on sekä viallinen ja mahdollisesti
yliampuva. Samalla demokraattinen kontorolli Euroopan
innovaatiopolitiikasta päättyy.
"Olemme pettyneitä, että niin moni parlamentin jäsen oli valmis
jättämään Euroopan tutkijat ja innovaattorit heitteille saavuttaaksen
poliittisen sopimuksen, minkä tahansa sopimuksen" sanoo Karsten
Gerloff, Free Software Founation Europen (FSFE) pääjohtaja. "On
luonnollista, että kun yhtenäisestä patentista on keskusteltu lähes
neljä vuosikymmentä, useat keskusteluun osallistuneet halusivat
yksinkertaisesti päättää väittelyn. Odotimme kuitenkin enemmän
vaaleilla valituilta edustajiltamme."
Voimakasta kritiikkiä kaikilta suunnilta
Hyväksyessään esityksen parlamentin jäsenet päättivät hylätä
voimakkaan kritiikin, jota kaikilta keskustelun puolilta esitettiin.
Patenttilakimiehet, itsenäiset oikeudelliset asiantuntijat,
pk-yritykset ja kansalaisjärjestöt, kuten FSFE, toivat esille
kritiikin parlamentin jäsenille. FSFE antaa tunnustusta sillä
tärkeälle työlle, joita eräät parlamentin jäsenet - erityisesti
Vihreät/EVA - tekivät informoidessaan kolleegojaan esityksen vakavista
virheellisyyksistä.
Tällä päätöksellä Euroopan parlamentti on tosiasiassa luopunut
vallastaan määritellä Euroopan innovaatiopolitiikkaa. Valta siirtyy
Euroopan patenttivirastolle, joka on osoittanut myöntävänsä
monopolioikeuksia laajimmalla mahdollisella tavalla.
"Olemme huolestuneita siitä, että sekä lainsäädännölliset että
täytäntöönpanevat valtaoikeudet siirtyvät yhdelle virastolle" sanoo
Karsten Gerloff. "Valtaoikeuksien jako on fundamentaalinen demokratian
periaate. Olemme pahoillamme siitä, että tämänpäiväisessä
äänestyksessä useat parlamentin jäsenet olivat valmiita luopumaan
tästä huonon kompromissin hyväksymiseksi."
Ohjelmistopatentit, hajautuminen ja sekaannus
Tänään hyväksytty päätöslauselma johtaa tuomioistuinten toimialueiden
ja päätöskäytännön hajautumiseen ympäri Eurooppaa. Lauselma luo
hajaantumista ja sekaannusta sekä tekee patenttijärjestelmän
ymmärtämisen paljon hankalammaksi pk-yrityksille. Euroopan
patenttivirastolla tulee olemaan vapaammat kädet jatkaa
ohjelmistopatenttien myöntämiskäytäntöään. Tämä haittaa kilpailua ja
innovaatiota ja luo tarpeettomia riskejä yrityksille ja
ohjelmistokehittäjille. Todennäköisesti hyväksytty päätöslauselma
johtaa myös voimistuvaan patentteja koskevaan oikeudenkäyntiaaltoon
Euroopassa, myös patenttipeikkojen toimesta.
FSFE on huolissaan myös siitä, että esityksestä puuttuvat poikkeus
tutkimustoimintaa koskien sekä määräykset pakkolisensseistä.
Immateriaalioikeuksiin keskittyneen Max Planck -instituutin mukaan
suunniteltu patenttituomioistuin on epäyhteensopiva Euroopan unionin
lainsäädännön kanssa. Nämä perustavat virheellisyydet tarkoittavat
epävarmuuden jatkumista siitä, miten patenttijärjestelmä tulee
toimimiaan tulevaisuudessa.
Seuraavat toimet
Euroopan parlamentin verkkosivujen mukaan "yhtenäisen
patenttituomioistuimen luova kansallinen sopimus tulee voimaan 1.
tammikuuta 2014, tai kun 13 jäsenvaltiota ovat hyväksyneet sen,
edellyttäen, että Yhdistynyt kuningaskunta, Ranska ja Saksa ovat
mukana näissä valtioissa. Kaksi muuta päätöstä tulee voimaan 1.
tammikuuta 2014, tai kun kansainvälinen sopimus tulee voimaan, sen
mukaan kumpi on myöhäisempi. Espanja ja Italia ovat nykyisellään
sääntelyn ulkopuolella, mutta voivat liittyä koska tahansa."

I've been randomly in contact with old family acquaintanceship Nils
Torvalds, who this summer got elected into the European parliament. We
is against software patents and he tried to convince other MEPs on the
subject.
In the message below he asked me to send him examples of how large
companies conduct to misuse the power of software patents. MEPs need
easy to understand concrete stories.
I know there is a lot of materials available, but the problem is,
which is the best if you can get a MEP to read just one link?

Efter omröstningen talade jag med Cecilia Wikström om poblemen. Hon
sade att hon också i fratiden kommer att hålla i patentfrågor. Efter
att jag hade förklarat för henne hur företagen bygger sina palissader
kring patent blev hon lite intresserad. Vi borde förse henne med
mycket konkreta beskrivningar av hur de stora företagen fungerar.
Jag kollar febuari-veckoslutet. Om jag är i Bryssel kommer jag gärna.
