You have to distinguish between personal views and the law or constitution.
Free Software is a personal view of this community, and so is the question about the moral.
A law has to give much wider borders, in which more than just one personal view can exist. Personal views are mostly always narrower.
Nobody wants to turn Free Software into a common law!
