<div class="paragraph"><p>Dieses Dokument ist eine Zusammenfassung des Chaosseminars, das am 28.10.2014 an
der Universität Zürich durchgeführt wurde. Es ging dabei um die zwei Gesetze
BÜPF und NDG.</p></div>
<div class="paragraph"><p>Vortragende waren Simon Gantenbein von der
<a href="http://digitale-gesellschaft.ch">digitalen Gesellschaft</a> und Hernani Marques vom
<a href="http://ccczh.ch">Chaos Computer Club Zürich</a>.</p></div>
<div class="paragraph"><p>Es soll einen Podcast des Vortrags geben. Bis jetzt scheint er noch nicht
verfügbar zu sein.</p></div>
<div class="paragraph"><p>Schon zu Beginn des Vortrags wurde darauf hingewiesen, dass die zwei Gesetze eng
miteinander zusammen hängen.</p></div>

<h2 id="_büpf">BÜPF</h2>
<div class="sectionbody">
<div class="paragraph"><p>BÜPF steht für „Bundesgesetz betreffend die Überwachung des Post- und
Fernmeldeverkehrs“.
Die geltende Version des BÜPF kann
<a href="http://www.admin.ch/opc/de/classified-compilation/20002162/index.html">hier</a>
gefunden werden.</p></div>

<h3 id="_totalrevision">Totalrevision</h3>
<div class="paragraph"><p>Das BÜPF soll total revidiert werden. Um was es dabei genau geht, findet sich
<a href="https://www.bj.admin.ch//bj/de/home/sicherheit/gesetzgebung/fernmeldeueberwachung.html">hier</a>.
Die Totalrevision ist vor allem strafrechtlich relevant. Hauptsächlich sollen
dabei die folgenden drei Bereiche angepasst werden.</p></div>

<h4 id="_erweiterter_geltungsbereich">Erweiterter Geltungsbereich</h4>
<div class="paragraph"><p>Es sollen viel mehr Organisationen zur Überwachung verpflichtet werden können.</p></div>
<div class="paragraph"><p><em>Kritik</em>: Wenn als Hauptkanäle der Kommunikation vor allem Dienste im Ausland
(z.B. Twitter) genutzt werden, dann hat das Gesetz darauf keinen Einfluss.</p></div>

<h4 id="_vorratsdatenspeicherung">Vorratsdatenspeicherung</h4>
<div class="paragraph"><p>Die wird bereits gemacht. Sie soll aber von sechs Monaten auf zwölf Monate
verdoppelt werden.</p></div>

<h4 id="_staatstrojaner_imsi_catcher">Staatstrojaner, IMSI-Catcher</h4>
<div class="paragraph"><p>Der Einsatz von Staatstrojanern und
<a href="http://de.wikipedia.org/wiki/IMSI-Catcher">IMSI-Catchern</a> soll auf eine
gesetzliche Grundlage gestellt werden.</p></div>
<div class="paragraph"><p><em>Kritik 1</em>: Wenn Sicherheitslücken in Software ausgenutzt werden, dann kann das
nicht nur der Staat tun, sondern jede Partei, welche die Sicherheitslücke kennt.
Insbesondere ausländische (Geheim)dienste.</p></div>
<div class="paragraph"><p><em>Kritik 2</em>: Da der Staat durch die Sicherheitslücke den vollen Zugriff auf einen
Computer erhält, kann nicht nachvollzogen werden, was auf dem Computer gemacht
wurde. Wer kontrolliert in diesem Fall den Staat?</p></div>
<div class="paragraph"><p>Am Rande: Der Kanton Zürich habe bereits zwei IMSI-Catcher angeschafft. Zu
welchem genauen Zweck sie gebraucht werden, sei unklar.</p></div>

<h2 id="_ndg">NDG</h2>

<div class="paragraph"><p>Das Nachrichtendienstgesetz (NDG) ist ein neues Gesetz. Die Medienmitteilung der
bundesrätlichen Botschaft findet sich

<div class="paragraph"><p><em>Kritik</em>: Der Nachrichtendienst erhält generell viel zu viel Kompetenz bei der
Überwachung.</p></div>

<h2 id="_diskussion">Diskussion</h2>

<div class="paragraph"><p>Nach dem Vortrag gab es eine Diskussion. Dabei wurde vor allem gegen BÜPF/NDG
argumentiert.</p></div>
<div class="paragraph"><p>Unter anderem kam Volker Birk zu Wort. Er hat in Deutschland zum Teil
erfolgreich gegen mehr Überwachung durch den Staat gekämpft. Auch vor dem EuGH.

<div class="paragraph"><p>Am 8. April 2014 hat der Europäische Gerichtshof (EuGH) die EU-Richtlinie zur
Vorratsdatenspeicherung mit sofortiger Wirkung für ungültig erklärt. Der EuGH
beurteilte die europäische Vorratsdatenspeicherung als unverhältnismässig und in
vollem Umfang als unvereinbar mit der Grundrechtecharta der EU.</p></div>

<div class="paragraph"><p>Ein Argument von Volker Birk war, dass es anscheinend noch keinen Fall gegeben
habe, bei der die Vorratsdatenspeicherung den Behörden geholfen habe, ein
Verbrechen zu klären.</p></div>
<div class="paragraph"><p>Ein weiteres Argument von ihm war, dass die Statistik zeige, dass der
Erfolg der Verbrechensbekämpfung nicht zurück gehe.</p></div>
